These Terms of Service (“Terms”) are a legal agreement between you (“you”, “Customer”, or “User”) and GET SAILS LLC (“Get Sails”, “we”, “us”, or “our”). By accessing or using https://getsails.com and any related services, software, sub-accounts, snapshots, training, or support (collectively, the “Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Getsails provides a software platform and related services that enable local service businesses to build funnels, manage leads, send email/SMS messaging, and run advertising campaigns. The Service may include white-labeled GoHighLevel sub-accounts, prebuilt funnel snapshots, course content, community access, and optional agency or managed services.

2. Eligibility

You must be at least 18 years old and have authority to enter into this agreement on behalf of any business or entity you represent. By using the Service you represent that you meet these requirements.

3. Accounts & Sub-Accounts

• To use certain features you must register for an account. You are responsible for keeping your account credentials secure and for all activity under your account.

• If you provision white-label sub-accounts (for clients), you are the account owner of those sub-accounts and remain responsible for client access, data, and compliance with these Terms and our Acceptable Use Policy (/acceptable-use).

• You must provide accurate information and promptly update any information that changes.

4. Free Trials & Billing

• Where a free trial is offered, you may be required to provide payment details to start the trial. Unless otherwise stated, at the end of the trial the subscription will automatically convert to a paid subscription at the plan rate and billing cadence you selected.

• By providing payment information you authorize us (or our payment processor) to charge the fees described in your plan. All fees are non-refundable except as expressly set out here.

• You are responsible for all taxes associated with your account (excluding taxes based on Getsails’ net income).

5. Fees, Payment & Refunds

• Subscription, onboarding/setup fees, management fees, and any additional service fees are billed as agreed in your order, invoice or onboarding paperwork. You agree to pay all fees in a timely manner.

• If you fail to pay fees when due, we may suspend or terminate your account after notice.

• Refunds: Except where required by law or otherwise stated in a written policy, fees are non-refundable. If you believe there is an error on an invoice, contact support within 30 days.

6. Messaging & SMS

• By providing phone numbers and opting in, you consent to receive automated and manual SMS/MMS messages as described in our SMS Terms (/sms-terms) and Privacy Policy (/privacy). You are responsible for ensuring you have rights to message numbers you upload and for obtaining any required consents from your end users.

• Getsails may rely on third-party messaging carriers and platforms (e.g., Twilio). We are not responsible for carrier delays, filtering, or blocking of messages. Charges from carriers to end users (if any) are the responsibility of the end user.

7. Acceptable Use and Prohibited Activities

• Your use of the Service must comply with our Acceptable Use Policy (/acceptable-use). Prohibited activities include, without limitation, sending spam, engaging in illegal activity, infringing third-party rights, or operating in restricted or high-risk verticals unless explicitly approved.

• We may suspend or terminate accounts that violate the Acceptable Use Policy or these Terms.

8. User Content & License

• “User Content” means any content you upload, submit or create using the Service (ads, landing pages, images, customer lists, etc.). You retain ownership of your User Content.

• By uploading User Content you grant Getsails a worldwide, non-exclusive, royalty-free license to host, copy, distribute and display it as necessary to provide the Service.

• You represent and warrant that you have all rights necessary to provide the User Content and that it does not violate any laws or third-party rights.

9. Intellectual Property

• Getsails and its licensors retain all rights, title and interest in and to the Service, software, templates, snapshots, course materials and documentation. Except for the limited license expressly granted herein, no rights are transferred to you.

• We grant you a limited, non-exclusive, non-transferable license to use the Service during the term of your subscription for your internal business purposes in accordance with these Terms.

10. Third-Party Services & Integrations

• The Service may integrate with third-party services (ad platforms, payment processors, analytics providers). Your use of those services may be subject to additional terms and privacy practices of the third parties. Getsails is not responsible for third-party actions or policies.

• If you connect third-party accounts (e.g., Facebook, Google, Stripe), you authorize Getsails to access and act on your behalf within those services to the extent permitted by that service.

11. Data, Backups & Account Closure

• You are responsible for backing up your own User Content. We may maintain backups and logs for operational purposes, but you should not rely solely on Getsails for backups beyond the retention period communicated.

• On account termination we may delete or anonymize your account and User Content after a reasonable period. If you terminate, export your data promptly.

12. Suspension & Termination

• We may suspend or terminate your account for material breach of these Terms, non-payment, or if we reasonably believe your use poses a security, fraud or legal risk. We will provide notice and an opportunity to cure unless immediate action is required.

• If we terminate for convenience, we will provide notice and refund any pre-paid, unused subscription fees on a pro-rata basis (if applicable).

13. Warranties & Disclaimers

• The Service is provided “AS IS” and “AS AVAILABLE” and Getsails expressly disclaims all warranties, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not warrant that the Service will be uninterrupted, error-free, or secure, or meet specific performance targets.

14. Limitation of Liability

• To the maximum extent permitted by law, Getsails’ total liability to you for any claim arising out of or related to the Service, whether in contract, tort (including negligence), or otherwise, will not exceed the total amounts paid by you to Getsails in the 12 months preceding the event giving rise to liability.

• In no event will Getsails be liable for any indirect, special, incidental, consequential, or punitive damages, lost profits, or loss of data, even if advised of the possibility.

15. Indemnification

You agree to indemnify, defend and hold harmless Getsails, its affiliates, officers, directors, employees and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your User Content; (c) your breach of these Terms; or (d) your violation of law or third-party rights.

16. Modifications

We may modify these Terms from time to time. For material changes we will provide notice (by email or on the Site) before the change takes effect. Continued use after the effective date constitutes acceptance of the updated Terms.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict of law principles. You and Getsails agree to submit to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona for any disputes arising under these Terms.

18. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, SMS Terms, and any ordering documents or policies incorporated by reference, constitute the entire agreement between you and Getsails.

• Severability: If any provision is found unenforceable, the remainder will remain in effect.

• No Waiver: Failure to enforce a right is not a waiver of that right.
